Tax Sale

Tax Sale by Public Tender

Municipal Tax Sales are governed by the Municipal Act, 2001. Ontario Regulation 181/03 requires properties to be sold by public tender be advertised for four (4) consecutive weeks in the local newspaper as well as on the Town’s website, kirklandlake.ca. The notice will also be published once in the Ontario Gazette during the four week notice period.

The tender amount must be equal to or greater than the Minimum Tender Amount as shown in the advertisement.

The highest tenderer will have an opportunity to purchase the property if they are able to submit the balance of their tendered bid within the required 14 day period. Failure to remit, the second highest tenderer will be given an opportunity to buy the property as only the two highest bids are retained by the municipality.

Prior to submitting a bid, the onus is on the potential bidder to conduct his/her own inquiries into such matters as zoning, work orders, access, building restrictions, title search, execution search, easements, etc. The Town makes no representation as to the quality and/or quantity of the land being sold.

The Town of Kirkland Lake does not have the ability to provide access to the properties being sold. The Town is not required to provide vacant possession of any properties, which may be occupied.

The tax sale can be cancelled by the treasurer at any time before a tax deed or notice of vesting is registered on title.

Tender Requirements

  1. A tender shall be in Form 7 (Tender to Purchase as per ).Reg 181/03, Form 7)
  2. Typewritten or legibly handwritten in ink
  3. Accompanied by a deposit of at least 20 percent of the tender amount, which deposit shall be made by way of money order or by way of bank draft or certified cheque
  4. Submitted in a sealed envelope which indicates on it that it is a tax sale and provides a short description or municipal address of the land sufficient to permit the treasurer to identify the parcel of land to which the tender relates
  5. Addressed to the treasurer
  6. A tender shall relate to only one parcel of land
If you chose to withdraw your submitted bid prior to the opening, a written request must be received by the Treasurer or designate before 3:00 pm on the last date for receiving tenders.
